By downloading, installing, or using nudge. ("the app"), you agree to these Terms of Use. If you do not agree, do not use the app.
nudge. is intended for users 18 years of age or older. By creating an account, you affirmatively confirm that you are at least 18 years old. If you are under 18, you may not use the app. We reserve the right to terminate accounts where we have reason to believe the user is under 18.
nudge. is a daily social challenge app that delivers real-world challenges and allows users to share their completions with friends. The app includes social features (posts, reactions, dares, friend connections, pacts), optional team challenges for organizations, and sponsored challenges from brands.
nudge. provides challenges for entertainment and personal development purposes only. You participate in all challenges entirely at your own risk. By using the app, you acknowledge and agree that:
This waiver of liability is a material condition of your use of the app. If you do not agree to assume full responsibility for your challenge participation, do not use the app.
You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:
You may submit posts, stories, photos, and other content ("User Content") through the app. By submitting User Content, you grant nudge. a non-exclusive, worldwide, royalty-free license to use, store, display, and moderate that content solely for the purpose of operating the app.
You represent and warrant that: (a) you own or have the right to share any content you submit; (b) your content does not violate the rights of any third party; and (c) your content complies with these terms.
We are not responsible for User Content posted by other users. Under Section 230 of the Communications Decency Act, nudge. is not the publisher or speaker of User Content and is not liable for it. However, we reserve the right to remove any content at our discretion.
nudge. has a zero-tolerance policy for objectionable content and abusive behavior. You agree not to post or transmit content that:
We use automated AI systems and human review to moderate content. Violations may result in content removal and account suspension or termination without notice.
Users can flag posts for review using the flag icon on any post. You can block users you find abusive. We commit to reviewing flagged content within 24 hours and taking appropriate action, which may include removing content and suspending or banning the responsible account.
nudge. offers an optional auto-renewable subscription called nudge. Pass. By purchasing a subscription:
Subscription prices are displayed in the app before purchase. Prices may change with reasonable notice.
nudge. Teams is an optional feature for organizations. Team owners may collect and view challenge completion data for their team members. If your organization uses nudge. Teams, you acknowledge that your completion activity within the team is visible to your team owner and co-owners. Your personal daily challenge activity outside of team challenges is never shared with team owners unless you are also mutual friends.
If you are a team owner, you agree to use member data only for the purpose of managing your team within nudge., and not to use it for any other purpose or share it with third parties.
By using nudge., you acknowledge that your username and score may appear on leaderboards visible to other users. If you do not consent to this during onboarding, or if you later change your mind, contact us at mike@nudgeme.today to request removal.
The nudge. app, its design, and all content created by us (including challenge text, branding, and interface elements) are owned by nudge. and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our written permission.
nudge. is provided "as is" without warranties of any kind, express or implied. We do not guarantee that the app will be available at all times, error-free, or free of security vulnerabilities. We make no warranty that the app will meet your requirements or that any errors will be corrected.
To the maximum extent permitted by applicable law, nudge. and its creators, officers, employees, and affiliates shall not be liable for any indirect, incidental, special, exemplary, or consequential damages arising from your use of or inability to use the app, including but not limited to loss of data, loss of revenue, loss of goodwill, or personal injury, even if advised of the possibility of such damages.
Our total liability to you for any claim arising from these terms or your use of the app shall not exceed the amount you paid us in the twelve months preceding the claim, or $100, whichever is greater.
Any dispute, controversy, or claim arising out of or relating to these terms or the app that cannot be resolved informally shall be settled by binding arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court. You waive any right to a jury trial or to participate in a class action lawsuit. The arbitration will take place in New Jersey. Nothing in this section prevents either party from seeking injunctive relief in court for intellectual property violations.
You may opt out of this arbitration agreement by emailing mike@nudgeme.today within 30 days of first accepting these terms.
We reserve the right to suspend or terminate your account at any time, with or without notice, for conduct that we believe violates these terms or is harmful to other users, us, or third parties. You may delete your account at any time from within the app under Settings.
These terms are governed by the laws of the State of New Jersey, United States, without regard to conflict of law principles. Any disputes not subject to arbitration shall be resolved in the state or federal courts located in New Jersey.
We may update these terms from time to time. We will notify users of material changes through the app. Your continued use of nudge. after changes are posted constitutes acceptance of the updated terms. If you do not agree to updated terms, you must stop using the app and may delete your account.
